If the property has been purchased jointly then you could partition it.  if not you can make a settlement in favor of your brother or vice versa.

Answer:
You could register under the special marriage act. You have to give a 30-day notice to the local registrar, and then submit proof of age and residence of the two of you.  Two witnesses are necessary.  If both of you are Hindus, please let me know; then there's a simpler procedure.

I am unaware of the rules of American citizenship. You have to contact an American lawyer.

Answer:
Yes, you could get married in India by registering under the special marriage act; if both of you are Hindus, and then the marriage could be under the Hindu marriage act. You could also have a valid marriage under the Malaysian law and it would be recognized in India if it is not opposed to public policy. Though there is no prohibition in grant of Indian citizenship to a spouse in the case of a marriage in a foreign country, it would be more advantageous to have the marriage in India.
