But we are ready to sign in any marriage related, registration papers for legality to my marriage. I request you, please send me the all details as soon as possible. Thank you very much. Have a nice day.
Answer:
This is a very unique situation. You could come there in fiancée visa and get married in US, since your girl friend is a US citizen. However you need to be engaged for that and should have met each other. We need photos of you together as proof. So my suggestion would be that your girl friend comes to India to meet with you and that is good for your immigration and also for personal life. If you need any further assistance please contact me.

Question:4
My fiancée has gone to USA since last 4 months and she got a Green Card on family based. What are the procedure for filing a fiancée Visa and how much time it will take for the clearance.
Answer:
Unfortunately there is a long wait. There is no fiancée visa for a green card holder. Fiancée visa are applicable only to US citizens. You have to wait for 5 years to avail that opportunity as he has to wait for 5 years to become a citizen. If you have to immigrate as a spouse of a green card holder you both have to get married and he has to file for relative petition. Even in this process there is a long wait. good luck.

Answer:
For this answer, I assume that you are a US citizen. You have to come to India and spend some time with him. Get engaged here and after going back you could apply for the fiancée visa. Should you need further assistance please feel free to contact me. You need to be above the poverty line/should have a joint sponsor who would be able to support him in case you are not able to support him. This is asked because he should not be a burden for the state or should get welfare in case you are not able to support him or your income is below the poverty guideline.

Question:8
I entered USA in October 98 on a visit visa after an year or so I got F1 after completion of my masters I got H1. Till now I did not go out of this country. I would like to marry an Indian girl in India, but I have a doubt that the reentry visa may or may not be given by the American consulate in India right? In such a case it is risky right? Suppose if I Marry an Indian girl already in USA with study visa or work permit how I should proceed for settling in us? what is your advise? I paid taxes for over one year or little less than one year and I have pay rolls etc.
Answer:
Hi. You are qualified and your experiences are genuine, mostly there shouldn’t be any issue in stamping. However as you have rightly said it is little riskier to get the stamping in India as you have changed the status from B-2 to f-1 and H-1. Marrying a nice girl there who can provide you with advance parole/LPR could help in this situation.
